Welcome to Eppie AI. These Terms of Service ("Terms") govern your access to and use of the Eppie AI platform, website, and services (collectively, the "Service"), operated by Eppie AI ("Company," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

Eppie AI is an AI-powered companion call platform. The Service places automated, personalized outbound phone calls to individuals designated by account holders ("Loved Ones"), sharing familiar stories, memories, and comforting conversation.

The Service is designed solely for companionship purposes. Eppie AI is NOT a medical device, healthcare service, therapy, counseling, or emergency service. The Service does not provide medical advice, diagnosis, treatment, or professional caregiving of any kind. The Service is not monitored by healthcare professionals and should never be used as a substitute for professional medical, psychological, or emergency care.

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use the Service. By creating an account, you represent that you meet these requirements.

3. Account Registration

To use the Service, you must create an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

4. Consent and Authorization

By using the Service to schedule calls to a Loved One, you represent and warrant that:

  • You have the legal authority to authorize automated, AI-generated phone calls to the designated Loved One.
  • You have obtained prior express consent from the Loved One (or their legal representative) to receive automated calls from the Service, as required by the Telephone Consumer Protection Act (TCPA) and applicable state laws.
  • You understand and acknowledge that all calls are generated by artificial intelligence and are not made by a human.

You are solely responsible for ensuring that proper consent has been obtained before any calls are placed.

5. AI-Generated Content

All call content is generated by artificial intelligence. The Service uses information you provide (stories, memories, names, and preferences) to craft personalized conversations.

You acknowledge and agree that:

  • AI-generated content may not always be accurate, complete, or appropriate.
  • The Company does not test, verify, endorse, or guarantee the accuracy or appropriateness of any AI-generated conversation content.
  • The Company is not responsible for the content of any calls placed by the Service.
  • You use the Service and rely on AI-generated content entirely at your own risk.
  • AI-generated content should not be treated as factual, professional advice, or a substitute for human judgment.

6. Call Data

Eppie AI does not record or store call audio. Calls are processed in real-time and are not retained after the call ends. No voice recordings, transcripts, or audio data are stored by the Company. For more details on what information we do collect, please see our Privacy Policy.

7. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation.
  • Harass, abuse, or harm any person.
  • Misrepresent AI-generated calls as being made by a human.
  • Provide false or misleading information in memory profiles.
  • Use the Service for any purpose other than personal, non-commercial companionship.
  • Attempt to reverse-engineer, decompile, or otherwise access the underlying technology of the Service.

8. Subscription and Payments

Certain features of the Service require a paid subscription. By subscribing, you agree to pay the applicable fees. Subscriptions automatically renew unless canceled before the renewal date. You may cancel your subscription at any time through your account settings. Refunds are handled on a case-by-case basis.

9. Intellectual Property

The Service, including its design, technology, branding, and all related intellectual property, is owned by the Company. You retain ownership of the content you submit (stories, memories, and personal information). By submitting content, you grant the Company a limited, non-exclusive license to use that content solely for the purpose of providing the Service.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. The Company disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that AI-generated content will be accurate, appropriate, or suitable for any particular purpose.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Without limiting the foregoing, the Company is not liable for:

  • The accuracy or appropriateness of AI-generated call content.
  • Any emotional distress, confusion, or other effects experienced by a Loved One during or after a call.
  • Any actions taken based on AI-generated conversations.
  • Service interruptions, delays, or failures to complete calls.
  • Unauthorized access to your account due to your failure to secure your credentials.

The Company's total aggregate liability for all claims arising out of or related to the Service shall not exceed the greater of (a) the total fees you paid to the Company in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars ($100).

12. Indemnification

You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of: (a) your use of the Service; (b) your violation of these Terms; (c) content you submit to the Service; (d) your failure to obtain proper consent for calls; or (e) claims by a Loved One or their representatives related to calls placed through the Service.

13. Termination

You may terminate your account at any time. The Company may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Sections 5, 10, 11, 12, 14, and 15 survive termination.

14. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws principles.

16. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service. Your continued use of the Service after any changes constitutes your acceptance of the updated Terms.
